Privacy policy

Effective date: 10/27/2026

What we collect through our website, forms, phone, email, and text messages, how we use it, and how to reach us. We do not share customer information with third parties for marketing purposes.

The short version

We do not share customer information with third parties for marketing purposes. We do not sell it either.

We collect what you give us through our forms, by phone, by email, and by text, so that someone on our intake team can answer you. We use it to respond, to verify insurance, to schedule, and to run our website. This page explains the details.

What this policy covers

This Privacy Policy applies to information Avion ABA collects through our website, our contact and intake forms, phone calls and emails with our intake team, and our text message program. Avion ABA provides in-home, school-based, and community-based ABA, and parent and caregiver training, for children and teens from 12 months to 18 years in New Jersey.

This policy is about our website and inquiries. It is separate from our Notice of Privacy Practices, which explains how we handle protected health information once a child is receiving services. See Protected health information below.

“We,” “us,” and “Avion ABA” mean Avion ABA, doing business as Avion ABA. “You” means anyone who visits the website or contacts us, usually a parent or caregiver.

Information we collect

Information you give us

When you fill out a form, call, email, or text us, you may give us:

  • Your name and your child’s first name and age
  • Your phone number and email address
  • Your county or town in New Jersey
  • The setting you are asking about: in-home, school-based, community-based, or parent and caregiver training
  • Your preferred way and time to be contacted
  • Your insurance carrier and plan, if you choose to share it so we can verify benefits
  • Who referred you, such as a pediatrician, a New Jersey Early Intervention provider, or a school team
  • Anything else you write in a message

Please keep first messages simple. You do not need to put a diagnosis, evaluation results, or detailed health history in a web form. Our intake team will ask for what is needed on a call.

Information we collect from text messages

If you agree to receive texts, we collect your mobile number, a record of your consent (the date and time, the form or channel used, and the exact consent wording shown), the content of messages sent and received, delivery status, and any STOP or HELP requests.

Information collected automatically

When you visit the website, we and our service providers may collect your IP address, browser and device type, the pages you view, the page that referred you, the county or approximate location your connection suggests, and how you move through the site. We use cookies and similar tools for this. See Cookies and analytics.

How we use information

We use information to:

  • Respond to your inquiry and set up an intake call
  • Verify your insurance plan and benefits before services begin
  • Check whether we have staff and openings in your county and setting
  • Send appointment reminders, account notifications, and general customer care messages, if you have agreed to text messages
  • Confirm receipt to a referring pediatrician, Early Intervention provider, or school team, when you have told us who referred you and agreed to it
  • Keep the website working, secure, and easy to use
  • Understand which pages and county pages are useful, so we can improve them
  • Meet legal, tax, insurance, and regulatory requirements
  • Protect our families, our team, and our rights

We do not use website form submissions or text message data to make decisions about eligibility for services. Eligibility is determined through assessment and insurance verification, not through this website.

This website is not for emergencies. If a child or anyone else is in immediate danger, call 911. If you or someone you know is in emotional crisis, call or text 988.

Text messaging

Avion ABA sends text messages only to people who have agreed to receive them by checking the consent box on one of our forms. The box is never pre-checked, and agreeing to texts is not required to submit a form or to receive services.

What we text about

Appointment reminders, account notifications, and general customer care. We do not send promotional or marketing texts. Message frequency varies. Message and data rates may apply.

How to stop or get help

Reply STOP at any time to opt out. You will get one message confirming you are unsubscribed, and then we will stop texting you. Reply HELP for assistance, or contact us using the details at the bottom of this page.

Please keep texts simple

Text messages are not a secure way to send health information. We keep our texts to scheduling and logistics, and we ask that you do not send diagnoses, test results, or other sensitive details by text.

Mobile information. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We use a messaging service provider to deliver texts. That provider handles messages only to send and receive them for us, and it is not permitted to use your number or message content for its own marketing. More detail is in the SMS program terms.

Sharing and disclosure

We do not share customer information with third parties for marketing purposes, and we do not sell personal information.

We share information only in these limited situations:

  • Service providers.Companies that help us run the business under contract: website hosting, form handling, our customer and intake records system, email, our text messaging platform, scheduling, and insurance verification. They may use your information only to perform services for us.
  • With your permission. For example, confirming receipt of a referral to the office that sent it, or speaking with your child’s school team.
  • Legal and safety reasons. When required by law, court order, or government request, or when needed to protect the safety of a child or another person.
  • Business changes. If Avion ABA is merged, sold, or reorganized, information may transfer to the successor, which must honor this policy.

Information that is not personally identifiable, such as overall website traffic counts, may be shared in summary form.

Cookies and analytics

Cookies are small files a website stores in your browser. We use them to keep pages working, remember basic preferences, and measure how visitors use the site, for example which county pages families read and which forms they finish. We may also use advertising measurement tools to learn whether our ads led to a visit or an inquiry. These tools collect technical and usage data. They are not given the contents of your forms or text messages.

You can block or delete cookies in your browser settings, and some browsers offer a “Do Not Track” or global privacy control signal. Turning off cookies may make parts of the site work less well. Some tools we use have their own privacy policies and opt-out options.

Storage, security, and retention

Information from forms, calls, emails, and texts is stored in secure systems run by us and our service providers. Access is limited to team members who need it to handle intake, scheduling, billing, and support. We use reasonable administrative, technical, and physical safeguards, including access controls and encrypted connections when you use the website.

No website or electronic message can be guaranteed to be completely secure, so please share only what you are comfortable sending.

We keep information only as long as we need it for the purposes above, to meet legal and insurance record-keeping duties, to resolve disputes, and to enforce our agreements. Inquiries that do not lead to services are kept for a limited period and then deleted or de-identified. Records of text consent are kept for as long as needed to show that you agreed. Records of children who receive services are kept for the periods required by New Jersey and federal law.

Protected health information

When a child becomes a client of Avion ABA, information about assessment, treatment, and care becomes protected health information under HIPAA and New Jersey law. We use and disclose it as described in our Notice of Privacy Practices, which also explains your rights, such as asking to see or correct records. [Link to Notice of Privacy Practices, once published]

If this policy and the Notice of Privacy Practices differ for health information, the Notice controls.

Children’s privacy

Our services are for children and teens, but this website is written for parents, caregivers, and other adults. We do not knowingly collect personal information directly from children under 13 through the website or text program. If you believe a child has sent us information without a parent or guardian’s involvement, contact us and we will delete it.

We never publish a child’s name, photo, diagnosis, or session details without written parental consent.

Your choices and rights

We may update this policy as our practice, services, or the law change. The updated version will be posted on this page with a new effective date. If a change materially affects how we handle text message data, we will tell you before it takes effect where the law requires.
